The Will of Humfrey Swindells of Ranowe Lowe 1627/8

Memorandm that the seconde daye of Februarie *** Anno dni scdm Cursum et Computacoem. Ecclie Anglicane Millimo Seycentessimo*
uicesimo septimo, Humfrey Swindells late of Ranowe Lowe in the Countie of Chester yoman Comonlie called little Humfrey Swindells being *
then sicke, and neere to the tyme of his death and being in pfecte memorye, did for the orderinge, disposinge and settlinge of his landes, goodes, *
Cattles and Chattles, after his decease, in the presence and hearinge of the psons whose names are hereunto subscribed as witnesses, expresse and
declare in wordes his laste will and testamt to the effecte and purporte followinge, vizt first hee did give and bequeath to Humfrey Swindells
his sonne and to his heires the mesuage and dwellinge house wth thappetennce in Ranowe aforesaid wherein the said Humfrey the sonne then *
did and nowe doth inhabite and dwell, and alsoe all the Closes, landes, meadowes, pastures and hereditamte the appetennc in Ranowe
aforesaid, then or late in the holdeinge or occupacon of the said Humfrey the sonne or his undertennte or assignes and called or knowen ***
respectivelie by the sevall names of the Middle haies, the hayes Clough and the Hair hole, To have and to holde to him the said Humfrey the
sonne his heires and assignes for ever, And whereas, certain percells of the Comons and waste grounde in Ranowe aforesaid Conteyninge by *
Estimacon nyne Acres of Cheshire measure or thereaboute, were formrly allotted or approynted out to the said Humfrey Swindells the testator
for his pte and purpte of the Comons and waste groundes in Ranowe aforesaid, for and in Respecte of all the said mesuage, lands and prmisses
aforesaid, upon or by force of the Composicon made between the kinges matie when he was Prince of Wales, and his highnes tennte of the
Manor and Forest of Macclesffeld afforesaid, hee the said Humfrey Swindells the Testator did then alsoe devise and bequeath and did then expresse his will
and mynde to be that Anne his wief holde have and enjoy twoe Closes and pcells of land wth  thappetennce latelie inclosed and taken furth of the said
Nine Acres of Comons and waste grounde and lyinge next unto the said mesuage, and also a full thirde pte of thother Sixe Acres of the said Comons and
waste groundes Residue of the said nyne Acres (into three pte devided) for and duringe all the tyme of her nrall lief, for and in the name of pte of her **
joyncture, and did then alsoe geve and devise the Remaynder and Renrcon of the said Twoe Closes to happen or come after or upon the decease of the said Anne *
unto the said Humfrey Swindells his sonne and his heires for ever, And hee did alsoe then expresse and declare his will and myde to be that
Philipp Swindells, John Swindells, Jasper Swindells, Edward Swindells Francis Swindells and Margaret Swindells his the late Testators yonger Children & their
heires sholde from and after his decease have and enjoy the other Twoe pte beinge the reste and residue of the said Sixe Acres of Comons and waste
grounde and alsoe sholde have and enjoy the Remaynder and Renrcon of the before mencoed Thirde pte of the saidfive Acres of comons and waste grounde from and after the decease
of the said Anne to be and Remayne to them the sais Philipp, John, Jasper, Edward, Francis and Margaret and their heires for ever And
whereas Thomas Shrigley thelder of Beristall gen, Alice his wief, Thomas Shrigley the yonger sonne and heire apparent of the said Thomas thelder
William Davenporte 0f Woodford Esquier, William Barneston gen, Richard Wych gen, John Shrigley of Bollington and Thomas Greene of waters, and Thomas Calveley
gen, Edward Greene & Edmund Howe did formrlie by Srrender by them acknowledged passed accordinge to the Custome of the Mannor & Forest of Macclesfeld
grannte, Convey & assure to Humfrey Swindells thelder of Ranowe aforesaid & to the said Humfrey Swindells the Testator & their heires for ever certen Closes, landes,
meadowes, pastures & pcells of land wth thapptennce in Ranowe aforesaid and Pott Shrigley or thone of them comonlie called the Oxeheyes to be holden accordinge to the
Custome of the said Mannor and Forest And whereas Jasper Willotte and Edward Barber did likewise formly by Serender by them acknowledged& passed according to
the custome aforesaid, grannte, assure & Convey unto the said Humfrey Swindels thelder and Humfrey Swindells the testator & to their heires for ever one mesuage with
thapprtennce in Ranowe afforesaid called Crow=mans howse and certen closes and pcells of land and meadows wth thapprtennce in Ranowe aforesaid called or knowen by the
names of the little meadowe and the longe field adioyninge to the little meadowe: to be holden as aforesaid accordinge to the sais custome , hee the said Humfrey Swindells the
testator for the disposinge and setlinge thereof did then also declare and expsse his will and mynde to be that the said Anne his wief sholde have & enjoy a full third parte
(into three pte divided) of the said messuage Closes, lands & prmisses respectivelie called Crowmans house the little meadowe and the longe field wth their apprtennce and a
thirde pte of his moytie of the Oxeheyes
