The will of John Nicholson of Randelhow, Eskdale 27th May 1832 (died 29th January 1833)

In the Name of God Amen, I John Nicholson of Randelhow in the Township of Eskdale, in the Parish of Saint Bees in the County of Cumberland, Yeoman, being Weak in Body, but of sound minde and memory, praised be God for the same, do make ordain, publish and declare this my last Will Testament and in manner and forme following, that is to say First I give and bequeath to my Mother Isabella Nicholson all my Household Furniture, and all my Personal Property, of what kind or nature soever or whensoever, and my will is that my Mother Isabella Nicholson pay all my just dets Funeral and Testamentary Expences, out of my Personal Property, I give and bequeath to Allis Nicholson the Rooms in the Oldhouse at Randelhow that she now occupies, for her own use during her natural Life, Rent free, I give bequeath and devise all that my Freehold Messuage and Tennement and Lands, Houses, Rights Privilidges and appurtenances whatsoever belonging there-unto and usually held and enjoyed therewith situated at and commonly called and known by the Name of Randelhow, in Eskdale in te Parish Saint Bees aforesaid, to Benjamin Biby of Howbank in the Township of Birkby in the Parish of Millom, Yeoman, John Russell of Langragreen in Eskdale aforesaid, Yeoman, and Porter Tyson of Eskdale, Hooper, and to there Heirs, Executors, Administrators of such survivor upon special trust and confidence, and to and for the purposes hereinafter particularly ordred and directed, namely that the my said Trustees and the survivors of them, and the Heirs, Executors and Adminstrators of such Survivors, do pay or give unto my Mother Isabella Nicholson all the Rents and profits arising out of the aforesaid trust real property yearly during the term of her natural life, and after her Decese, my will is that the my said Trustees do pay or give unto my Daughter Hannah Nichol, all the Rents and profits of the aforesaid trust real property, yearly during her Natural life, but in case she Die before her Youngest Child attains the age of Twenty one in that case, I will and order that it be payed to her Husband Joseph Nichol for the maintenance of her Children until the youngest Child attains the age of Twenty one, and I will and order that my said Trustees do sell all that my aforesaid trust real property within on year after after the Decese of my Doughter Hannah Nichol, if her youngest Child have attained the age of Twenty one, if not within one year after youngest Child has attained the age of Twenty one; and that they dispose of the Money arising out of the Sale of the aforesaid trust real property on the following manner that they pay themselves for all reasonable expences and loss of time that the may be put to, in execution and fulfilling of the trust here on them reposed, and the shall not be recoverable for the acts and deeds any one of them my do, but every one of them answerable for his own acts and Deeds and my will is that the divide the residue of the money, amongst all the Children, (or there Lawful Issue if parents be dead) of my Daughter Hannah Nichol share and share alike, and lastly I nominat and apoint the aforesaid Benjamin Biby, John Russell, and Porter Tyson Executors of this my last Will and Testament hereby revoking all former Wills by me made.
In witness whereof I have hereunto set my hand and Seal this Twentyseventh day of May in the year of our Lord one thousand Eight hundred and Thirty two.

Before the Reverend John Gaitskell Clerk Batchelor of Arts Surrogate the last will of John Nicholson Late of Randel How in the Township of Eskdale in the Parish of St Bees in the County of Cumberland Yeoman deceased was proved and the execution thereof committed to Benjamin Bibby, John Russell and Porter Tyson the Executors therein named.
