In ye Name of God Amen. October ye Eight Day one Thousand
Seven hundred & forty four I Nicholas Hartley of Whase in
Eskdale in ye parish of St Bees & County of Cumberland Yeoman
at this time Beeing very weack in Body but in perfect
mind & memory Do make this my Last will & Testament
First I Bequeath my Soul to Almighty God that gave it
me & my Body to ye Ground to be Buried in Christian manr.
at ye discrition of my Executor, And as for my worldly goodes
I Give & Dispose of as foloweth
I Give unto my Son in Law William Dickinson ye Some
of Twenty Poundes, I Give unto my Daughter Mary
Hartley ye Sime of Twenty Poundes. I give unto
my Daughter Elizabeth Hartley ye Same Twenty
Pounds: I Give unto my Son Henry Hartley
ye Sime of Two Shilings & Six pence. I Give
unto my Beloved Wife Mary Hartley whom
I make my Hole & Sole Exxetor of this my Last
will & Testament all my Goods & Chattells Living
& Dead, & She is to pay all my Legacy & all y Debts
& Funel Expences as witnes my Hand
ye Said William & his wife is but to have what [I ] have got

Admonition

Know all Men by these Presents that We Mary Heartley of Whase in Eskdale in the County of Cumberland Widow and Edward Tyson of Eskdale aforesaid Surgeon are holden, and firmly bound unto the Right Reverend Father in God, Samuel, Lord Bishop of Chester, in Three Hundred Pounds of good and lawful Money of Great Britain, to be paid to the said Right Reverend Father or to his certain Attorney, his Executors, Administrators, or Assigns; to which Payment, well and truly to be made, We bind ourselves, and each of Us our Heirs, Executors, and Administrators firmly by these Presents, sealed with our Seals, Dated the eighth Day of May in the Year of our Lord One Thousand seven Hundred and forty five

The Condition of this Obligation is such, That if the above bounden Mary Heartley shall and do well and truly execute, and perform the last Will and Testament of Nicholas Heartley late of Whase in Eskdale aforesaid yeoman Deceased; and do pay all his Debts and Legacys, so far as his Goods and Personal Estate will extend, and the Law shall bind her if also she do exhibit into Court a true and perfect Inventary of the said Deceased’s Goods and Personal Estate, and give a true and just Accompte of her acting in the Premises, when she shall be thereunto lawfully called; That then this Obligation to be void, or else in Force.
