In the name of God Amen I Robert Swindell of Weston In the County of Derby yeoman being sick butt of disposing mind and memory do make this my laste will In manner following:
Imprimis I give and devise all my land in Packington unto my loving wife Mary Swindell for her Life and after her decease I give and devise the same unto my son Thomas Swindell and his heires for ever.
Item I give and devise my Lease and all my lands and tenements In Weston unto my wife for the bringing upp of all my five children untill my son Thomas attaines the age of one and twenty years and then I give and devise the farm unto him and his heires forever.
Item I give and devise all my personal estate whattsoever unto Robert Harding Esqr. and Nicholas Swindell and to the Survivors of them In truste for the payment of my juste debts and funerall expenses and afterwards for their equal age and benefitte off my fourer younger children to be paid to them at theire severall ages of one and twenty yeares or marriage which shall first happen share and share alike and if any of them die before that age that then the share of them for dieing to be paid one halfe to the survivor of my younger children and the other halfe to my eldeste sonne Thomas Swindell and I desire that all the said monyes arising by the sale of my personall estate household goods excepted to be lefte unsold at the discretion of Robert Harding, Nicholas Swindell and my Loveing wife for the necessary use of her and her children be putt oute at Intereste and the Intereste thereof to be paid to my Loveing wife for the better bringing uppe of my children until It becomes payable to them as aforesaid If she remaine continued sole and unmarried butt upon her marriage that the Interest to be applied to the bringing up of my children by my brother Nicholas Swindell and John Seale and allsoe the rente of my lease in Weston. And it is my minde and will and I desire that such payment of the monye arising by sale of my Stock as Robert Harding, Nicholas Swindell and my wife shall at any time thinke fitte shall be payde and disposed off for the putting any of them to Apprentices and be decucted oute of the shares of them for put out when they come to age. And I make and constitute the afroesaid Robert Harding, Nicholas Swindell and my Loving wife Executors of this my will. In witness whereof I have hereunto put my hand and seale this fifth day of December one thousand six hundred ninety and four.
